Israeli prosecutors filed charges on 1–2 September against 12 current and former Israel Prison Service staff over the death of Thaer Abu Asab, a 38-year-old Palestinian from the West Bank, at Ketziot Prison on 18 November 2023. The indictment in Beersheba District Court lists reckless homicide, aggravated serious bodily harm, and multiple counts of aggravated assault causing bodily harm. The shift commander and shift sergeant also face obstruction charges. Hebrew media have described the homicide count as involuntary manslaughter. The facts alleged are the same.
Prosecutors say a dozen officers entered the cell Abu Asab shared with eight other detainees during an evening head count, then punched, kicked, and in some cases used clubs. Haaretz reported that the shift commander told the group to go in to "show the prisoners there is no cease-fire." Abu Asab collapsed after the officers left. Other prisoners called for help. Clinic staff found him without a pulse and not breathing. He was revived, taken to Soroka Medical Center in Beersheba, and pronounced dead at 22:22. The indictment says he had multiple broken ribs and tears in the walls of the heart, with bleeding around the organ, and that those injuries caused the death. Eight other men in the cell were beaten, prosecutors say. Some defendants are accused of lining up their stories before police interviews.
Abu Asab was a Fatah member serving 25 years for attempted murder from a 2005 conviction, according to Hebrew outlets. The Public Committee Against Torture in Israel says more than 100 Palestinian detainees have died in Israeli custody since October 2023 and that this is the first case it knows of in that period in which anyone has been charged in such a death. Ketziot is a desert facility in the south, used for security prisoners. The date of the alleged beating, 18 November 2023, falls in the first weeks after Hamas's 7 October attack, when the prison service was under political pressure to harden conditions.
An indictment is not a verdict. It is the state saying it can prove a cause of death and name the people in the cell. The medical detail in the filing is the part that will be tested first: rib fractures and a torn heart wall after a count, not after a fall or a pre-existing condition. The obstruction counts against the two senior men on the shift are the part that will test whether the file stops at the officers who went in or reaches the people who told them to.
Rights groups have published death lists from Israeli detention for three years and have rarely seen a charge sheet. Prosecutors in Beersheba have now produced one with twelve names, a time of death, and a mechanism. The court will have to decide if that mechanism holds. Until then the concrete fact is the filing itself. A security prisoner who died in November 2023 has a homicide case attached to him in September 2026. That is new. It is also late.
