Utah judge sends Charlie Kirk murder case to trial with death penalty live

District Judge Tony Graf ruled on Tuesday that Tyler Robinson will stand trial for the killing of conservative activist Charlie Kirk at Utah Valley University on 10 September 2025. Graf found probable cause on all seven counts, including aggravated murder, which can carry a death sentence in Utah. Robinson, 23, pleaded not guilty after the ruling. He is due back on 23 October at 1 p.m. for a status conference and has been ordered to appear.
Prosecutors say Robinson fired a single rifle round from a rooftop more than 400 feet away while Kirk spoke to a crowd of thousands in Orem. Kirk, 31, was hit in the neck. The state argues the shot passed over people, including children, and that Robinson knew others stood near the stage. That risk-to-bystanders claim is the aggravator that keeps capital punishment on the table.
Defence lawyers said the state overstated DNA and ballistic evidence and failed to show that anyone else was actually threatened. Graf said the facts support a reasonable inference that the shooter knew other people stood near Kirk. He stressed that probable cause is not a finding of guilt. Proof beyond a reasonable doubt is for a jury.
The other counts are felony discharge of a firearm causing serious bodily injury, two counts of obstruction of justice, two counts of witness tampering, and a violent offence committed in the presence of a child. Kirk's parents and widow Erika sat in the Provo courtroom. Donald Trump Jr. attended parts of the hearing. Robinson's family sat near the front.
Prosecutors last summer laid out security video, digital records and forensic material. They have said they will seek death if they win a conviction. Utah still allows a firing squad as a method. Steve Burton of the Utah Defence Attorney Association noted that Graf could have sent the case forward on simple murder, which carries 15 years to life, and chose not to.
A preliminary hearing is a filter, not a trial. What changed on Tuesday is that the filter stayed open on the capital charge. The defence now prepares a jury case on identity, forensics and the mental state required for aggravation. The state prepares the same facts it used this week, under a higher burden.
Kirk's killing last September froze a stretch of U.S. campus politics and made the defendant a national name before any jury was seated. Graf's order returns the file to the slower clock of a Utah capital case. The date that now matters is 23 October, when the court will be asked to set a trial calendar.
