Supreme Court to form special Bench on OBC creamy-layer criteria for CSE 2025

The Supreme Court of India on August 25, 2026 agreed to consider constituting a special Bench to hear the Centre’s plea on the application of its March 11 judgment concerning the OBC creamy-layer criteria to candidates of the Civil Services Examination 2025.

The March 11 ruling had addressed how the creamy layer is determined for Other Backward Classes in the context of reservation. The Centre has sought clarification on whether that ruling affects candidates who already appeared in the 2025 examination cycle.

A Bench of the court took note of the request and indicated it would examine the need for a special Bench. The matter involves the eligibility of candidates who may fall on either side of the creamy-layer threshold under the clarified criteria.

Civil services examinations are conducted by the Union Public Service Commission. Results and subsequent allocation processes depend on accurate application of reservation rules. Any change in the interpretation of the creamy layer can affect rank lists, category certificates and final appointments.

The Centre’s plea argues that candidates who took the examination under the previous understanding of the rules should not face retrospective disadvantage. Opposing parties may contend that the judgment must apply uniformly.

The creamy-layer concept excludes relatively better-off members of OBCs from reservation benefits. Income and status criteria determine who falls within the layer. Periodic revision of those criteria and judicial interpretation have generated repeated litigation.

The court’s decision to consider a special Bench signals the institutional importance of the issue. Special Benches are typically formed for matters that require focused attention or that cut across multiple pending cases.

Candidates who appeared in CSE 2025 are currently at various stages of the process, from written results to interviews and medical examinations. Clarity on the creamy-layer application will determine whether certain candidates remain eligible under the reserved category or must be treated as general-category aspirants.

The government has previously issued notifications and affidavits seeking to protect candidates already in the pipeline. The Supreme Court’s eventual ruling will set the binding interpretation for the 2025 cycle and potentially for future examinations.

No final order on the merits has been passed. The court has only indicated it will examine the request for a special Bench. Further hearings will determine the scope of any clarification and the effective date of the March 11 judgment for this examination.
