Supreme Court to Consider Special Bench on OBC Creamy Layer Criteria for Civil Services Exams

The Supreme Court of India on August 25, 2026, agreed to consider constituting a special Bench to hear the Centre’s plea seeking clarification on the applicability of its March 11 judgment on OBC creamy-layer criteria to candidates of the Civil Services Examination 2025 and 2026.

The Department of Personnel and Training has asked the court for directions that would allow the government to proceed with service allocation for 958 candidates recommended by the Union Public Service Commission on the basis of the creamy-layer determination applied before the March verdict.

The March 11 ruling had addressed the criteria used to exclude the creamy layer from reservation benefits for Other Backward Classes. The Centre’s application seeks to resolve uncertainty over whether that ruling affects candidates already in the pipeline for the current examination cycles.

Service allocation for successful candidates is a time-sensitive administrative process. Any delay or retrospective change in eligibility rules creates practical difficulties for both the government and the individuals concerned. The request for a special Bench reflects the scale of the issue and the need for an authoritative resolution.
