Hochul said new information had raised serious questions about how the case was handled, and that she had lost faith in the Tompkins County district attorney's ability to oversee it fairly. In a longer statement she said the young woman at the centre of the case deserved to know that every fact would be examined. She tied that loss of faith to two things: the decision by District Attorney Matthew Van Houten not to prosecute in 2024, and questions raised in recent days about the Cornell University Police Department's investigation.
The woman, identified in court papers as Jane Doe, was a 20-year-old sophomore. In a civil lawsuit filed last month she said she was plied with alcohol and drugs and then raped by several men at the fraternity house. She reported the encounter to Cornell police several weeks later. No criminal charges were filed. The lawsuit pushed the allegation into national view and brought students to a public hearing in Ithaca. Facing that outcry, Van Houten said on Monday that his office would reopen the investigation. He had not answered requests for comment by Thursday night.
James had already begun a review of how law enforcement handled the matter. Hochul's appointment moves that review into a prosecutorial brief. James said the case would be investigated fully and fairly. On X she said she stood ready to lead a process guided by the facts and the law, and that her office did not take the assignment lightly.
The legal mechanics matter more than the titles. A special prosecutor appointed by the governor can take the file out of the county office that already declined charges, gather evidence the campus police collected in 2024, and decide whether a grand jury in Tompkins County, or another venue if the order allows, ever hears it. Hochul said James may prosecute offences arising from the investigation. That is a charging power, not a commentary role.
The timeline is short and awkward. The alleged rape is 19 October 2024. The report to Cornell police came weeks later. Nearly two years passed with no charges. The civil suit landed in September 2026. Van Houten reopened the file on Monday. Hochul moved James in on Thursday night. Anyone reconstructing a 2024 fraternity-house case now is working with delayed interviews, possible lost video, and witnesses who have left campus. That delay is part of what Hochul said undercut public faith.
Cornell sits in Ithaca, inside Tompkins County. Campus police and the county district attorney share the first response to crimes reported on and near the university. The lawsuit has raised the question of why that chain produced no charges. Hochul did not publish the new information she cited. Until Friday's briefing, the public record is the appointment, the October 2024 date, the Chi Phi house, the sophomore's account in the September suit, and Van Houten's Monday reversal.
James is the state's chief legal officer. Putting her on a single campus case is unusual and is meant to answer the charge of a local conflict. It also puts a statewide office on a file that a county prosecutor already closed once. If the grand jury returns no indictment, the state will own that outcome. If it does indict, the charging decisions of 2024 become evidence in their own right.
Friday morning's joint update is the next dated event. What it needs to answer is narrow: which agency holds the 2024 interviews, whether the fraternity's own records were ever subpoenaed, and whether the statute of limitations on any count is already running out. The appointment settles who asks those questions. It does not settle what the file contains.
